Information on the consumer buyer's right of withdrawal

Under section 8:1(1) point 3 of the Hungarian Civil Code, only a natural person acting outside their profession, independent occupation or business activity qualifies as a consumer, so legal persons cannot exercise the right of withdrawal without giving a reason!

Under section 20 of Hungarian Government Decree 45/2014 (II. 26.), the consumer has a right of withdrawal without giving a reason. The consumer may exercise the right of withdrawal

a) in case of a contract for the sale of a product
aa) of the product,
ab) in case of the purchase of several products, where the individual products are supplied at different times, of the product supplied last,

within the deadline counted from the day of receipt by the consumer or by a third party other than the carrier indicated by the consumer, which deadline is  14 days.

The provisions of this point do not affect the consumer's right to exercise the right of withdrawal set out in this point in the period between the day the contract is concluded and the day the product is received.

If the offer to conclude the contract was made by the consumer, the consumer has the right to withdraw the offer before the contract is concluded, which ends the binding nature of the offer as regards concluding the contract.

The declaration of withdrawal, exercising the consumer's right of withdrawal or termination

The consumer may exercise the right granted by section 20 of Government Decree 45/2014 (II. 26.) by a clear declaration to that effect, or by using the model declaration that can also be downloaded from the website.

The validity of the consumer's declaration of withdrawal

The right of withdrawal is deemed to have been exercised in time if the consumer sends the declaration within the deadline. The deadline is 14 days.

The burden of proving that the right of withdrawal was exercised in accordance with this provision lies with the consumer.

After receiving the consumer's declaration of withdrawal, the Seller is obliged to confirm it on an electronic data carrier.

The Seller's obligations in case of the consumer's withdrawal

The Seller's refund obligation

If the consumer withdraws from the contract in accordance with section 22 of Government Decree 45/2014 (II. 26.), the Seller refunds the full amount paid by the consumer as consideration, including the costs incurred in connection with performance such as the shipping charge, within fourteen days at the latest of becoming aware of the withdrawal. Please note that this provision does not apply to the additional costs caused by choosing a mode of transport other than the least expensive standard mode of transport.

How the Seller fulfils its refund obligation

In case of withdrawal or termination in accordance with section 22 of Government Decree 45/2014 (II. 26.), the Seller refunds the amount due to the consumer using the same payment method the consumer used. On the consumer's express consent the Seller may use another payment method for the refund, but the consumer may not incur any additional charge as a result. The Seller is not liable for a delay caused by a bank account number or postal address given incorrectly and/or inaccurately by the Consumer.

Additional costs

If the consumer expressly chooses a mode of transport other than the least expensive standard mode of transport, the Seller is not obliged to refund the additional costs arising from that. In such a case our refund obligation exists up to the general shipping charges shown.

Right of retention

The Seller may withhold the amount due to the consumer until the consumer has returned the product or has proved beyond doubt that it was sent back; whichever is the earlier is to be taken into account. We are unable to accept consignments sent cash on delivery or carriage forward.

The consumer's obligations in case of withdrawal or termination

Returning the product

If the consumer withdraws from the contract in accordance with section 22 of Government Decree 45/2014 (II. 26.), they are obliged to return the product without delay, and within fourteen days at the latest of communicating the withdrawal, or to hand it over to the Seller or to a person authorised by the Seller to receive the product. The return is deemed to have been made in time if the consumer sends the product before the deadline expires.

Bearing the direct costs of returning the product

The consumer bears the direct cost of returning the product. The product must be returned to the Seller's address. If, after performance has begun, the consumer terminates a contract for the provision of a service concluded off premises or at a distance, they are obliged to pay the business a fee proportionate to the service performed up to the time the termination was communicated to the business. The amount payable proportionately by the consumer is to be determined on the basis of the total amount of the consideration set out in the contract, increased by tax. If the consumer proves that the total amount so determined is excessive, the proportionate amount is to be calculated on the basis of the market value of the services performed up to the time the contract ended. Please note that we are unable to accept a product returned cash on delivery or carriage forward.

The consumer's liability for depreciation in value

The consumer is liable for any depreciation in value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.

The right of withdrawal cannot be exercised in the following cases

The Seller expressly draws your attention to the fact that you cannot exercise your right of withdrawal in the cases set out in section 29(1) of Government Decree 45/2014 (II. 26.):

  1. in case of a contract for the provision of a service, after the service has been performed in full, if the business began performance with the consumer's express prior consent and the consumer acknowledged that they lose the right of termination once the service has been performed in full;
  2. in respect of a product or service whose price or fee depends on fluctuations of the financial market that cannot be influenced by the business and that are possible even within the deadline set for exercising the right of withdrawal;
  3. in case of a product that is not prefabricated and was produced on the consumer's instructions or at their express request, or a product that was clearly personalised for the consumer;
  4. in respect of a perishable product or one that keeps its quality only for a short time;
  5. in respect of a sealed product that, for health protection or hygiene reasons, cannot be returned after being opened following delivery;
  6. in respect of a product that, by its nature, becomes inseparably mixed with another product after delivery;
  7. in respect of an alcoholic drink whose actual value depends on market fluctuations that cannot be influenced by the business, the price of which was agreed by the parties when the sales contract was concluded, but where the contract is performed only after the thirtieth day from its conclusion;
  8. in case of a works contract where the business visits the consumer at the consumer's express request in order to carry out urgent repair or maintenance work;
  9. in respect of the sale of a copy of a sound or video recording in sealed packaging, or of computer software, if the consumer opened the packaging after delivery;
  10. in respect of newspapers, journals and periodicals, with the exception of subscription contracts;
  11. in case of contracts concluded at a public auction;
  12. with the exception of housing services, in case of a contract for the provision of accommodation, transport, car rental, catering or a service related to leisure activities, if a specific date or deadline for performance was set in the contract;
  13. in respect of digital content not supplied on a tangible medium, if the business began performance with the consumer's express prior consent and the consumer declared at the same time as giving that consent that they acknowledge losing the right of withdrawal once performance has begun.
